Drunk Driving. Despite stricter laws and the efforts by the police, politicians, and activist groups like MADD, drunk driving remains a key issue in the U.S.

How many fatalities were there in 2008 from teen drunk driving?

I need a shocking statistic about teen drunk driving to start off an essay. I was trying to find how many deaths occurred, but I can only find the total amount resulting from alcohol. I need just teens. If anybody can find this number, it would be greatly appreciated. Or if you have some other shocking statistic on it, that would be a lot of help too. Also, if you can give me the site you found it on that would be great.

Drunk Driving Attorney. When a person gets arrested for drunk driving, he often needs to hire a drunk driving attorney to fight for his legal rights.

Can you become a attorney with a criminal record?

I have a drunk driving and a battery on my record, both misdemeanors, and both from Utah. I plan to go to law school next year in NY, and practice there. Will I have a problem? Will NY know about my record? Will they care about misdemeanors?

Best bet is to be upfront on the law school application because if you get through law school and pass the state bar exam you will have to go through the ethic part, they will pull your law school application, you have to be fingerprinted to sit for the bar so they will run a background check,

The DWI is not big deal, the battery is a different situation most likely it will not bar you from law school but may cause you to go in front of the ethic committee to be approve admission to practice law in the state

There’s a big difference between a DUI and a DWI. Not just legally, but financially and criminally. The only way to be certain is to know the legal limits and to take an alcohol breath test. An alcohol breath test will give you an exact alcohol to blood content, which is what the police use to enforce the drunk driving laws that are so vigilant.

Using an alcohol breath test is the most common and easy way to find out if and how much alcohol a person has consumed. In all states there are drinking laws. An alcohol breath test, usually preceded by a field sobriety test, is the way that a policeman deduces whether or not you’ve been drinking, and if you’ve been drinking excessively before or while you were behind the wheel of a car.

Once it is determined that you’ve been drinking an alcohol breath test will help to determine your alcohol blood content, or the amount of alcohol in your blood, which is used to distinguish the charge.

The difference being, usually by one tenth of a percentage, that you are either legally drunk and driving, which results in a driving while intoxicated charge which gives the stiffest of penalties, or that you are charged with a driving under the influence charge, which means you are guilty of having driven after imbibing alcohol, but that you weren’t legally drunk.

In most states these days one is considered drunk if they blow a .10, and anything beneath that, a .008 for instance, means you will be charged with a DUI. In both cases, if you are found guilty, the penalties are severe. A DWI penalty can be life altering, requiring loss of license, substantial jail time, and large financial penalties.

Of course drinking and driving accidents kill far too many people, most of whom are innocent bystanders, so penalties should be harsh. That being said, an alcohol breath test can be an inaccurate tests, and field sobriety test can be way off. You can appear drunk if you are fatigued. It is your right to not take an alcohol breath test, but in most cases the law then presumes that you are guilty.

The best way to know for certain if you have any doubts is to not drive. Get a cab or have a designated driver drive you around. If that is not possible, the second best thing you can do is administer your own alcohol breath test. They make digital alcohol breath tests and breath analyzers that range in price from fifty dollars to a few hundred dollars that are as accurate as any breath test that the police department or government agencies might use.

Some jobs require that you take random alcohol breath tests and these are usually the devices used. The fact of the matter is that it’s wrong to drink and drive and can be dangerous to you and to those around you.

The best way to avoid trouble is to simply not drink and drive. Police and prosecutors, however, rely heavily, almost solely on alcohol breath tests when it comes to drinking and driving cases. If you are involved in a drinking and driving case, it is best to have all the info available to you about the matter.

If you’ve been convicted before it could be imperative that you have your own way to self-administer an alcohol breath test. It could save lives.

Drunk driving accidents are completely preventable. They are also taken very seriously and drunk drivers face extreme punishment under the law. Most states have strengthened their drunk driving laws to include severe punishments for even first time offenders. If you are involved in a drunk driving accident then you need to be aware of what may happen if you were behind the wheel.

Understanding Drunk Driving

Many people are guilty of drunk driving. For a lot of those people, they were unaware that they were drunk enough to be considered over the legal limit. The legal limit for the amount of alcohol a person can have in their system while driving varies from state to state. Most states, though, have very strict limits.

In some states, a person is considered drunk if they have consumed a 12 ounce beer, 5 ounces of wine or a 1.5 ounce shot of whiskey. Many people think that having one drink is fine and that they are legal to drive, but as you see, that is often not the case. Even if you are in a minor accident, being found to be under the influence of alcohol means you will be charged with drunk driving. You will face harsh penalties.

Defenses of Drunk Driving

If you are involved in an accident and have been charged with drunk driving you will need to seek legal assistance right away. There are some defenses that can be used to fight drunk driving charges. Such defenses can help keep you from losing your license or from going to jail. Only an experienced lawyer, though, can help you to win your case in court.

While you may not be able to completely get off from the drunk driving charges, you can still fight lawsuits from the other parties involved in the accident. One such defense that you can use to keep another party from recovering damages is contributory negligence. Contributory negligence is when the other person’s actions somehow contributed to their injuries.

Comparative negligence is another form of defense to prevent a party from claiming damages. It reduces the amount of judgment based upon the fault of the plaintiff. For example, if the defendant is found guilty for 60% of the accident then the plaintiff can only claim damages of 40%.

If you are being sued by a passenger that was in your car then, depending on the law in your state, you may be able to use the defense of contributory negligence or comparative negligence or assumption of the risk. This basically means that your passenger knew when getting into the vehicle that you were under the influence and therefore is somewhat responsible for their own injury.

When you have been involved in a drunk driving accident as a result of your own actions, you must step up and take responsibility. You should get help for your drinking problem. If it was a simple oversight and you were not intoxicated, but merely above the legal limit then you should take care in the future to avoid getting yourself in such a situation. Drinking and driving is very serious as every year there are countless people who lose their lives as a result of drunk driving.

Multiple DUIs and the Death of Two College Students

A few years ago a drunk driver killed two Hiram college students.  Somehow, this driver had received 12 DUIs over a ten-year period of time.  I remember the outrage people had about the deaths of the two college students and also about the fact that this driver received so many DUIs.  In fact, some people were wondering what kind of punishment the judges administered when this driver received his eighth, ninth, tenth, and eleventh DUIs.  In short, a lot of people were wondering if the judges merely “slapped the driver’s wrist” without administering a more severe form of punishment such as sentencing him to jail for a number of years.

Other people wondered if the driver was ever forced to go to mandatory alcohol treatment.  After all, if this person had a serious drinking problem and continued to drive “under the influence,” doesn’t it make sense that he should have been ordered by the court to get the alcohol rehab he needed in order to address his hazardous and dangerous drinking?

As it turned out, the driver was eventually sentenced to somewhere around thirty-five years in jail.  Regrettably, it took the deaths of two college students to put this irresponsible drunk driver behind bars.  Question.  Are judges who “go lightly” on people with multiple DUIs part of the problem?

Based on various alcohol related statistics and facts, in the U.S. as in most, if not all, developed countries in the world, alcohol abuse in general and people who drive and drink in particular is or is becoming a major societal problem.  As a result, in some countries, some new and different approaches have been developed in the hopes of significantly reducing the number of “repeat” DUIs, DWIs, or drunk driving incidents.

For instance, in some states in the U.S. part of the DUI course curriculum requires offenders to meet face-to-face with the person or persons they injured in an alcohol-related accident.  In these meetings, the people on the receiving end of an alcohol-related accident reveal their distressing and painful stories of how a drunk driver forever changed their lives.  The rationale behind such a program is that by personalizing the suffering and the pain that driving and drinking can lead to might make the offender stop and think about what he or she is doing before getting behind the wheel after drinking.

Stricter Drunk Driving Laws

Many states currently have drunk driving laws that provide far stricter penalties for various situations.  The following list shows some of these special circumstances:  if the driver was under the age of 21 at the time of his or her arrest, if the driver’s blood alcohol concentration exceeded a certain level, if a child was in the vehicle, or if someone was injured.

I don’t know if these “enhanced” penalties for drunk driving are significantly reducing the number of drunk driving instances, but from a common sense perspective, these stricter penalties make sense.
