Drunk driving or driving under the influence (DUI) is the act of driving a motor vehicle under the influence of alcohol or while in an inebriated condition. It is a common problem in the United States and the rest of the world. DUI is responsible for 41 percent of total traffic deaths.

Alcohol tends to get absorbed into the bloodstream and is carried to the brain immediately upon consumption. Laws in the US in relation to DUI have become extremely strict. In the state of California alone there are approximately 200,000 arrests for DUI every year. The law has enforced strict and stringent measures against people who have found to have a blood alcohol count of 0.08% or more.

Based on California law, a person under the influence of alcohol is charged on two counts, a Vehicle Code section 23152(a) count, driving impaired by alcohol and 23152(b), driving above a .08% Blood Alcohol Content.

California Highway Patrol records, 1998 states that in 1997, a total of 31,189 people were injured in alcohol-related traffic accidents in California. This comes down to approximately 86 people per day. Injuries caused in such accidents comprise of roughly 10.94% of the total 284,871 traffic injuries in California. It also states that in 1997, a total of 1,100 people were killed in alcohol-related accidents in California – this equates to 3 people per day. These deaths roughly represent almost 29.96% of the total 3,671 traffic fatalities in California.

Strict and stringent laws have been enacted to deal with offenders caught while DUI. Jail sentences range from 2 days to 120 days depending on the intensity of the offence. Similarly DUI schooling may also be recommended. This may range from 15 weeks to 18 months. Sale of the vehicle or impounding may also take place with the proceeds going towards charity.

Statistics have proved that since the enactment of the 0.08% blood alcohol count, the DUI arrests have decreased by an assenting rate of 45%. The number of deaths and injuries has also shown a 50% decrease. This is a positive indication, which proves that to an extent, the imposition of fines and punishments has shown affirmative results.

Alcohol offenses are serious crimes, which carry major consequences if convicted. An alcohol related crime can be one of many subcategories including, DUI, DWI, underage drinking, public drunken behavior and the illegal distribution, production and sale of liquor.

Annoying insurance company/ rehab program?

Ok I have recently found god and become a strong christian. I came home after tons and tons of drug issues from college. My parents are very supportive and my mom is a strong christian. Two centers have been trying to help us with the insurance companies. I want to go to a christian rehab center and the one that has a very very good ministry outreach program was denied because it was not on their list of recommended centers. My whole life I have had to deal with big corporations I am so sick of them and usually have luck when calling them. How should me and my parents handle this issue with the insurance? I mean it is complete bs that we pay them tons of money and when it comes time to actually do their jobs they are refusing to. Is their someone we can call to help us deal with them or something? I really feel that I am being lead to be at this facility does anyone have any suggestions at all. Please just be kind in responses no bs just logical solutions to this problem.

It depends upon the type of plan you have. If you have the wrong plan you are out of luck.

If you have an HMO plan and the center is not in their network you cannot get them to pay. You can still go but you’ll have to pay.

If you have a PPO or a POS plan you can go and they’ll pay a smaller portion than if the center was in their network. You also may have a separate deductible.

If you have an indemnity plan you can go and they’ll pay.

Some Drinkers Just Don’t Get It

female depressed over drinking problemShirley just didn’t get it.  After receiving three DUIs and after getting rushed to the emergency room twice for alcohol poisoning she still could not stop drinking.  To make things worse, she had already gone to alcohol treatment three times.  Ironically, one time after going through rehab, Shirley stayed sober for three-and-a-half years.

As soon as something problematic came her way, however, she “dealt with” things by drinking abusively.  Once again Shirley is now in jail and once again she is undergoing mandatory alcohol rehab while she is incarcerated.

This time, however, she will not get released from jail until she has successfully undergone alcohol rehabilitation and remained sober for at least ten weeks.  Furthermore, she will have to agree to attend outpatient alcohol treatment and accept random alcohol testing before she is released from jail.  Will Shirley eventually “get it” and avoid drinking altogether?  Only time will tell.

One important reason for this is that many people with drinking issues do not realize or admit that they have a drinking problem. Indeed, why fix what isn’t broke?

People who engage in chronic alcohol abuse or alcoholism are also notorious for establishing a sophisticated denial system. For instance, some long-term heavy drinkers, when asked about their drinking problem, respond with “what alcohol problem? I don’t have an alcohol problem.”

lady upset with her abusive drinkingSharon was a problem drinker who had just received her third “driving under the influence” arrest.  When Sharon went before the court, the Judge told her that her drinking behavior was unpardonable and as a consequence, he was going to sentence her to serve four months in jail.

While in jail, Sharon would be required to get alcohol treatment and learn more about alcohol abuse and alcoholism, binge drinking, and the adverse outcomes of abusive and excessive drinking.

The judge highlighted the fact that unless Sharon gets professional alcohol rehab and learns how to live in an alcohol-free manner, she would be spending a considerable amount of time in jail.  Sharon seemed to understand but told the judge that she still believed that jail was not the proper punishment.  The judge disagreed, saying that it was his responsibility to keep drinkers who receive multiple DUIs off the roads.

male teen in distress from alcohol abuseWhat is the key difference between alcohol abuse prevention and alcohol abuse rehab?   Alcohol abuse prevention centers on avoiding or stopping one’s drinking before it becomes a problem.  On the other hand, alcohol abuse rehab focuses on dealing with the drinking situation after it has become a serious problem.

Basically, alcohol abuse treatment is an example of reactive problem solving while alcohol abuse prevention is an illustration of proactive problem solving.

Clearly if alcohol abuse could be prevented one hundred percent of the time, there would be no need for alcohol rehab.  Because this isn’t the case, then again, alcohol abuse therefore needs to be addressed both reactively and proactively.

Male Teen Looking  Lost From Alcohol AbuseLet us admit the truth:  most people drink because alcohol makes them feel good.  The difficulty with this, however, is that the law of diminishing returns eventually rears its ugly head and takes over.  What this means is that up to a certain point, the more alcohol a person drinks the better he or she feels.  Once a certain point is reached, however, increased drinking begins to lead to ill health, sickness, negative feelings, and drinking problems.

When this point is reached, unfortunately, the person is engaging in abusive drinking.  To avoid this state of affairs, we have to learn how to get the positive effects from alcohol without drinking to an excess.  Due to the fact that this is not easy to do, maybe the best way to accomplish this is to limit one’s drinking to one or two drinks once or twice per week.  Even though everyone is different, this drinking in moderation “plan” is probably doable for most individuals.

Classy Woman Drinking by Card TableCinny had made a special effort to stop drinking at least twice per year the past ten years.  She was from the “old school” that said that an individual had to be tough enough to do things by herself without another person’s assistance.  Indeed, this mentality was the basic reason why she failed to talk to her physician about her drinking problem or why she never thought about getting alcohol rehab.  Things changed abruptly, however, when she got fired for theft at her place of employment.  Due to her drinking problem, Cinny’s finances were going South at an increasing rate.  So she thought he would “borrow” some money from the petty cash for which she was responsible.

Since her place of employment had a zero tolerance policy for theft, she was fired immediately the day her theft was discovered.  Surprisingly, this served as a wake-up call and encouraged her to get an alcohol appraisal.  Finally Cinny was doing something positive about her drinking problem.  Maybe now, Cinny would be able to follow through on her attempt to quit drinking.

More than a few studies have shown that roughly half of the alcohol dependent individuals who have successfully undergone alcohol treatment will relapse at least once within 6-12 months after completing treatment.  The bottom line:  remaining alcohol-free is extremely hard for most alcohol-addicted individuals.  In fact, some alcoholism experts claim that relapse is part of the alcohol recovery process.

There’s another message, however, that underlies these statistics.  If you are an alcohol abuser, why not get alcohol rehab before you run the risk of becoming alcohol dependent?  If you have a drinking problem, why gamble with your life?   Why not straighten out your act by getting alcohol rehab before you become an alcoholic?  Sure, living an alcohol-life may be difficult, but do you really want to ruin your health, lose your job, destroy your most important relationships, and wreck havoc with your finances?  If you continue drinking to the extent that you become an alcoholic, these and other alcohol related problems are highly likely.

The alcoholism and alcohol abuse research literature demonstrates the fact that non-alcoholic family members can begin to move on with their lives and “recover” whether the alcohol dependent person is still drinking or not. But this can’t happen until someone in the family picks up the telephone and calls for help at a reputable alcohol treatment facility or an alcohol rehab hospital.  In short, if someone takes the time and effort, he or she will discover that there is definitely help and hope for alcoholics and for his or her family members.
